Redundancy: the options
What is redundancy?
Redundancy is when you dismiss an employee because you no longer:
- carry out the business for which they are employed
- carry out the business in the place where they are employed
- require them to carry out work of a particular kind
- require them to carry out work of a particular kind in the place where they are employed
For a redundancy to be genuine, you must demonstrate that the employee's job will no longer exist.
In this situation, eligible employees would be entitled to receive a statutory redundancy payment (SRP) - read more on the rights of redundant employees. Some employers offer enhanced redundancy payments over and above the statutory amount as a goodwill gesture or part of a broader redundancy process. Unless the employer has a clear contractual entitlement or binding agreement, enhanced redundancy pay is often discretionary.
